1 Eligibility & Rental Requirements

To rent a vehicle from RentMyWhips, you must satisfy all of the following requirements at the time of rental:

RentMyWhips reserves the right to deny a rental to any individual who does not meet these requirements or who presents fraudulent documentation. Misrepresentation of eligibility is a violation of these Terms and may result in immediate termination of the rental agreement without refund.

2 Authorized Drivers

Only the individual named on the rental agreement as the primary renter and any additional drivers who have been pre-approved in writing by RentMyWhips may operate the rented vehicle. All authorized drivers must meet the same eligibility requirements as the primary renter. Allowing an unauthorized person to operate the vehicle is a material breach of these Terms and may result in the immediate termination of the rental, forfeiture of the security deposit, and liability for any resulting damages.

3 Insurance Requirements

Under O.C.G.A. § 40-9-102, any person who rents a motor vehicle from a U-drive-it owner (such as RentMyWhips) is required to provide their own automobile liability insurance. Your personal auto insurance policy is the primary coverage for any liability arising from your use of the rented vehicle.

You must provide verifiable proof of insurance prior to taking possession of the vehicle. If your personal insurance does not extend to rental vehicles, or if you prefer additional protection, you may purchase one of our optional insurance waivers at the time of rental. The optional insurance waiver is not a substitute for a full insurance policy; it is a contractual agreement that limits your financial liability to RentMyWhips for damage to the rented vehicle under the terms specified in the waiver agreement.

4 Payments, Deposits & Fees

All rental charges, fees, and the security deposit are due at the time of vehicle pick-up unless otherwise agreed in writing. We accept the following forms of payment:

• Credit Card (Visa, Mastercard, American Express, Discover)
• Debit Card
• Zelle
• Cash

Payments processed through our website are handled securely by Stripe. RentMyWhips does not store your full payment card details.

5 Cancellations & Refunds

Reservations may be canceled subject to the following policy:

• More than 48 hours before pick-up: Full refund of any prepaid rental charges.
• Within 48 hours of pick-up: A cancellation fee equal to one day's rental rate will be charged. The remainder of any prepaid charges will be refunded.
• No-Show: If you fail to pick up the vehicle without canceling, the full rental charge and security deposit may be forfeited.

Security deposit refunds are processed within 3–5 business days following the return of the vehicle in satisfactory condition. Deductions may be made from the deposit for damages, excessive cleaning, fuel shortfalls, late fees, or other outstanding charges.

6 Vehicle Use & Restrictions

The rented vehicle may only be used for lawful purposes and in accordance with these Terms. The following uses are strictly prohibited:

• Operating the vehicle while under the influence of alcohol, illegal drugs, or any substance that impairs driving ability.
• Using the vehicle for any illegal purpose or in furtherance of any criminal activity.
• Transporting passengers or property for compensation (e.g., rideshare services such as Uber or Lyft, delivery services) without prior written authorization from RentMyWhips.
• Participating in any race, speed contest, or off-road driving.
• Using the vehicle to tow, push, or propel any other vehicle or object.
• Allowing any unauthorized person to operate the vehicle.
• Smoking or vaping inside the vehicle. A cleaning fee will be assessed for violations.
• Transporting animals in the vehicle without prior written approval. A cleaning fee may apply.

Violation of any of these restrictions constitutes a material breach of this agreement and may result in immediate termination of the rental, forfeiture of the security deposit, and liability for all resulting damages and costs.

7 GPS Tracking & Monitoring

Our vehicles may be equipped with GPS tracking technology. By accepting these Terms and taking possession of a rented vehicle, you expressly consent to the monitoring of the vehicle's location throughout the rental period. GPS data may be used to:

• Recover the vehicle in the event of theft or failure to return.
• Verify compliance with geographic restrictions and prohibited uses.
• Assist law enforcement in investigating unauthorized use of the vehicle.
• Support insurance claims or legal proceedings.

GPS data is not used for advertising purposes and is not shared with third parties except as described in our Privacy Policy or as required by law.

8 Optional Add-Ons

RentMyWhips offers the following optional add-ons, subject to availability at the time of rental:

All add-ons must be selected and paid for at the time of vehicle pick-up. Add-ons cannot be added or removed mid-rental without prior written approval from RentMyWhips.

9 Fuel Policy

All vehicles are provided with a full tank of fuel. You are required to return the vehicle with a full tank of fuel. If the vehicle is returned with less than a full tank, you will be charged for the cost of the missing fuel at current local market rates, plus a refueling service fee. Pre-purchased fuel options are not available.

10 Vehicle Condition & Damage

You are responsible for the vehicle from the time you take possession until the time it is returned to RentMyWhips and inspected by our staff. You must inspect the vehicle at pick-up and report any pre-existing damage to a RentMyWhips representative before departing. Any damage not documented at pick-up will be presumed to have occurred during your rental period.

You are financially responsible for all damage to the vehicle that occurs during your rental, including but not limited to collision damage, theft, vandalism, and interior damage, unless you have purchased an applicable insurance waiver and the damage falls within the scope of that waiver. You are also responsible for any damage caused by prohibited uses of the vehicle as outlined in Section 6.

In the event of an accident, you must: (1) immediately notify local law enforcement; (2) obtain the other party's insurance and contact information; (3) notify RentMyWhips as soon as practicable; and (4) cooperate fully with any insurance investigation.

11 Limitation of Liability

To the fullest extent permitted by the laws of the State of Georgia, RentMyWhips LLC, its members, managers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the rented vehicle or the Site, even if RentMyWhips has been advised of the possibility of such damages.

In no event shall RentMyWhips's total liability to you for all claims arising out of or related to a single rental transaction exceed the total rental fees paid by you for that specific rental transaction.

Nothing in this section shall limit RentMyWhips's liability for gross negligence, willful misconduct, or any liability that cannot be excluded or limited under applicable Georgia law.

12 Indemnification

You agree to indemnify, defend, and hold harmless RentMyWhips LLC, its members, managers, officers, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the rented vehicle; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any accident, injury, or property damage caused by you or any authorized driver during the rental period; or (e) any misrepresentation made by you in connection with the rental.

13 Fair Business Practices

RentMyWhips operates in full compliance with the Georgia Fair Business Practices Act (O.C.G.A. § 10-1-390 et seq.), which prohibits unfair or deceptive acts or practices in consumer transactions. We are committed to transparent pricing, honest advertising, and fair dealing with all customers.

All rental rates, fees, and surcharges are disclosed to you prior to the completion of your reservation. If you believe that RentMyWhips has engaged in an unfair or deceptive practice, you may contact us directly to resolve the matter. You may also file a complaint with the Georgia Attorney General's Consumer Protection Division at consumer.georgia.gov.

14 Governing Law & Dispute Resolution

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of our services, shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Fulton County, Georgia. You hereby irrevocably consent to the personal jurisdiction and venue of such courts.

15 Modifications to Terms

RentMyWhips reserves the right to modify these Terms at any time in its sole discretion. All changes are effective immediately upon posting to the Site. The "Effective Date" at the top of this page will be updated to reflect the date of the most recent revision. Your continued use of our services following the posting of revised Terms constitutes your acceptance of and agreement to the changes. We encourage you to review these Terms periodically.
